" The passage of the Act did not resolve the question of Alaska Native water rights. This article covers the legal argument on Native water rights as impacted by ANCSA, characterizes Native water rights as riparian, prior appropriation, or federal reserved rights; discusses navigable waters, the Winters Doctrine water rights, the Paug-Vik case (litigation addressing Alaska Native water rights), and Alaska's Water Use Act. the article proposes language regarding water rights for the Alaska National Interest Lands Claims Act under discussion at the time, and analyzes the question of public easements over Native lands and water rights. The article concludes that the question of Alaska Native water rights whould be settled on a state-wide basis. The issues are doubly crucial for Alaska is the last untapped major water reserve and Native water rights on Native selected lands are critical for Native subsistence economies and continued commercial developments." 1
