"This article discusses the precedents for the concept of Indian title, and applies them to Alaska. It reviews Native litigation against the United States and against third parties, and addresses the relationship of the Statehood Act and extinguishment of aboriginal title. It reviews cases relative to aboriginal title in Alaska before and after Statehood, and the authority of the Secretary of the Interior to issue leases on public lands regardless of any claim of Indian title. The article concludes that while tribal owned aboriginal Indian title does not represent use and occupancy of a nature protected by the 1994 and 1900 Organic Acts, actual use and more permanent occupancy are protected against intrusion by third parties."1
